How to report material on mlsimport.com that you believe infringes your copyright, and what happens after you do.

Most copyright questions we receive are about listing photos, and most of those are not ours to resolve. MLSimport is a plugin: listing data and photos come from an MLS, over that MLS’s API, using credentials the site owner holds. Photos are served from the MLS or its CDN and are not stored on our servers or copied to the customer’s.

  • If the material is on mlsimport.com, send us a notice using the form below.
  • If the material is a listing or listing photo on a customer’s website, the fastest route is the MLS that syndicates it, and the site owner. We can pass a notice along, but we cannot remove data from a feed we do not own.

What a valid notice contains

To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
  2. Identification of the copyrighted work you say has been infringed.
  3. Identification of the material you are asking us to remove, with enough detail to locate it. A direct URL is best.
  4. Your contact details: name, address, telephone number and email address.
  5. A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on their behalf.

Notices that leave out one of the six elements cannot be acted on, and we will write back asking for the missing piece rather than guessing.

Email [email protected] with “DMCA notice” in the subject line, or use the contact form. Please send one notice per work where practical.

What happens next

  1. We acknowledge receipt.
  2. If the notice is complete and the material is ours to remove, we remove or disable access to it.
  3. If the material belongs to a customer or originates in an MLS feed, we forward the notice to the party who can act on it and tell you we have done so.
  4. We keep a record of the notice and the action taken.

Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same address. It must include your signature, identification of the material and where it appeared before removal, a statement under penalty of perjury that you have a good faith belief the removal was a mistake, your contact details, and your consent to the jurisdiction of the appropriate court.

Misrepresentation and repeat infringers

Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages. We also terminate, in appropriate circumstances, the accounts of subscribers who are repeat infringers.
